Freedom to Care Act
Summary
The Freedom to Care Act provides liability protection for volunteers of non-profit organizations provided the volunteer was acting within the scope of responsibilities, was properly licensed, certified, or authorized - if required by law. The liability protection is not afforded to a volunteer who was committing an offence or unlawfully using or impaired by alcohol or drugs at the time of the incident complained about. The liability protection is also not afforded to a volunteer who caused the damage while operating a motor vehicle, vessel, aircraft or other vehicle for which the owner is required by law to maintain insurance.
A volunteer is entitled to costs on a solicitor-and-client basis where an action is brought against a volunteer for damages caused by an act or omission of the volunteer acting on behalf of a non-profit organization if the action does not result in a judgment against the volunteer.
